Freedom of expression is one of the most important rights central upon the development of any democratic society. Law Focus looks at this exercise of expression on social media and how it can be limited through interdicts and protection orders.
Social media law specialist and partner at PPM Attorneys, Diana Schwarz begins the discussion by providing an exposition on defamation. We speak to former Deputy Public Relations Officer at African Diaspora Forum, Gugulethu Ncube on the interim protection order she received for her posts on Facebook about her alleged rape. The Chairperson of the African Diaspora Forum, Marc Gbaffou responds to the rape allegations made by Ms Ncube.
Director of Southern African Division of Human Rights Watch, Dewa Mavhinga, closes off the discussion on defamation laws and provides an account of Stella Nyanzi’s trial for defamatory posts she made on Facebook.
UPDATE: The legal matter between Mr Gbaffou and Ms Ncube was not pursued by the courts. According to Hillbrow Police station, there was no prima facie evidence and the current status of the case was adjudicated as ‘Nil Prosecution’ as of 11 August 2017.
