Two pieces of legislation are in the pipeline to regulate communities in rural areas. On the one hand, the Traditional Courts Bill, which regulates the administration of justice in traditional courts. On the other hand, we have the Traditional Khoi-San and Leadership Bill, which aims to regulate rural governance. Both pieces of legislation have come under criticism. Issues of gender representation, accountability, authority of tribal leaders and re-enforcement of Apartheid geographical governance structures are some of the key objections. On this edition of Law Focus, we unpack the implications of both pieces of legislation.

Director, Ntinga Ntaba kaNdoda, a community led project that works with 28 rural
organizations that are challenging the Traditional Khoi-San and Leadership Bill
in the Eastern Cape region.
